OVERVIEW
Tony Ventura is a civil litigation attorney whose practice includes real estate, business, construction and insurance litigation. Tony’s practice primarily involves real estate litigation involving both residential and commercial real estate disputes. In residential disputes, Tony represents buyers, sellers, agents, and brokers in claims arising from breach of contract, failures to disclose, negligence and breach of fiduciary duties. Tony also represents buyers and trustors in matters arising from non-judicial foreclosure sales. In commercial disputes, Tony represents both buyers and sellers, owners and tenants, and commercial real estate brokers in disputes arising from the sale or lease of commercial property. Tony practices both in state and federal court throughout California as well as before the California Appellate Court and various administrative and regulatory agencies.

REPRESENTATIVE MATTERS

Successfully represented the buyer of a residential home in a dispute with the seller, a beneficiary under a deed of trust, and a title company where the title company failed to identify a deed of trust recorded against the seller’s interest in the property prior to the sale.

Prevailed for a seller of a residential home in an action where the buyer alleged that the seller failed to disclose certain conditions of the home.

Currently serving as corporate counsel for several residential real estate brokers to provide advice as to specific issues involving residential real estate transactions and the operation of the business, as well as serving as defense counsel in actions filed against the brokers and their agents.

Represented a commercial real estate broker in an action to recover a commission from the owner of a commercial space pursuant to a lease

Obtained a favorable settlement for a client in a commercial lease dispute with a landlord to enforce the client’s rights to perform tenant improvements and obtain a release of the security upon completion of the improvements.
